Can we fix it?

Dear oh dear, as one might say.

Its been another long week.

Judgment was handed down recently in an interesting case on fixed costs I had some involvement in, courtesy of instructions from Daniel Wilkinson at Horwich Farrelly.

There are a number of points in the case, which repay consideration: including agreements to contract out of fixed costs (or not), the effect of part 36 offers in fixed costs cases and the limited scope for the application of the principle of exceptional circumstances.
