I appeared unled for the claimant in a multi-day preliminary issues hearing concerning whether a solicitor had been retained and whether substantial fees were payable. The Senior Costs Judge held that no express or implied solicitor-client retainer existed.
Tescher v Direct Accident Management Ltd [2025] EWCA Civ 733
I appeared with Benjamin Williams KC for Direct Accident Management Ltd in joined appeals concerning non-party costs orders against credit hire companies where QOCS prevented enforcement against the claimants. The Court of Appeal gave general guidance on the jurisdiction.
Excalibur & Keswick Groundworks Ltd v McDonald [2023] EWCA Civ 18
I appeared for the respondent in an appeal concerning discontinuance, strike-out and loss of QOCS protection. The Court considered the meaning of conduct “likely to obstruct the just disposal of the proceedings”.
University Hospitals of Derby & Burton NHS Foundation Trust v Harrison [2022] EWCA Civ 1660
I appeared for the respondent in an appeal concerning QOCS and the costs consequences of late acceptance of a Part 36 offer, including whether the resulting order was an order for damages and interest for enforcement purposes.
Herbert v HH Law Ltd [2019] EWCA Civ 527
I appeared as junior counsel for the appellant solicitors in a leading appeal on solicitor-client detailed assessment, including success fees, client approval and the treatment of an ATE insurance premium.
Essar Oilfields Services Ltd v Norscot Rig Management Pvt Ltd [2016] EWHC 2361 (Comm)
I appeared for Essar in a challenge under section 68 of the Arbitration Act 1996 concerning whether third-party funding costs could be recovered as costs of the arbitration.
