A recent trip to Middlesbrough, saw a successful appeal to the Circuit Judge, HHJ Robinson, on the vexed question of pre-allocation costs and the application of the case of Birmingham City Council v Lee.
Costs battles in housing disrepair claims, are often exercises in bare knuckle savagery, so I was pleased to encounter instead, the courtesy of Peter Marcus, acting for the respondent.
