Retainers and WIP

For many years I have drafted retainers of all types for use by solicitors and claims management companies, including private retainers, conditional fee agreements (CFAs), collective conditional fee agreements (CCFAs) and damages based agreements (DBAs).

I have also advised on numerous occasions on the retainer issues thrown up by  the purchase of firms and work in progress and the best and most effective ways to ensure that valid and effective retainers are in place, when a client changes solicitor or, a solicitor moves firm.

I am fully familiar with the law of assignment and novation, and the formality requirements imposed by the various regulatory regimes, having been advising on the effect of the Solicitors Act 1974, Solicitors Practice Rules (as they were then) the Courts and Legal Services Act 1990 and the original Conditional Fee Agreements Regulations.
